Why we collect personal data
As part of the commercial operation of brokerage, we hold data including that of boat owners, potential boat buyers, previous boat owners, suppliers, customers, contractors and past & present employees.
What we collect and how we use it
We collect personal information to allow us to process enquiries, facilitate the buying and selling of boats, and provide related services. This may include, but is not limited to: your name, postal address, email address, and phone number.
In order to comply with Anti-Money Laundering regulations, we may also collect photographic ID, utility bills, and proof or source of funds.
Your data is used to provide the services you request and to communicate with you about your interest in boats or related services. We may contact you by post, telephone, or email.
We only request bank details when necessary to make payment to you. These details are securely processed and are not retained once the payment has been completed.
We do not sell data to any third party. Data is used for brokerage business purposes, and is only shared when part of a sale transaction, such as : other parties within the sale contract; surveyors; docking facilities; and financial institutions.
We provide a service of contacting parties interested in boats for sale, through an opted-in facility, primarily via our website or face-to-face interaction. Each and every communication regarding boats for sale includes an unsubscribe facility.
We retain personal data only for as long as necessary to meet statutory, legal or legitimate commercial requirements.
Telephone recordings
Incoming and outgoing telephone calls are recorded for training, monitoring, and compliance purposes. Recordings are stored on a password encrypted server operated by our telephone provider for three months. Where a caller provides bank details for the purpose of receiving boat fund payments, the call recording will be manually paused to ensure compliance with the Payment Card Industry Data Security Standards (PCI DSS). Recording will resume once the details have been received.
Access to call recordings is strictly controlled in line with Data Protection legislation and is limited to the Data Controller.
In the case of a Subject Access Request, individuals may request access to their own call recordings. Requests from external bodies with law enforcement powers (e.g. Police, Home Office, DWP, HMRC) must be made in writing to the Data Controller, who will consider the request in line with legal obligations.
Access to data and removal of data
You have the right to request access to, correction of, or removal of the personal data we hold about you, by completing our online Data Request Form. Proof of identification will be required for such requests.
Requests to remove data may not always be possible if the consequence would be such that we would not meet statutory, legal or commercial requirements.
You will not usually have to pay a fee to exercise your data rights. However, we may charge a reasonable fee if a request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply in these limited circumstances.
You have the right to make a complaint at any time to the Information Commissioner's Office (“ICO”), the UK regulator for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.
